While regulations could take years and may face court challenges, the EPA has firmly taken the ball of climate change into their court by declaring carbon dioxide emissions and other global warming gasses a public health risk.
It all stems back to a 2007 case which made it to the Supreme Court. Five out of nine Supreme Court justices ruled that they considered carbon dioxide and other greenhouse gasses to be pollutants. They then smacked the ball to the EPA by asking them to declare global warming gasses to be a health risk. The EPA then sent a report to the Bush administration showing its findings that global warming gasses were, indeed, a health risk. Bush spent his remaining years in office resisting this decision. With the Obama administration in place, the EPA has been given the green light to draft regulations that will deal with climate change.
