Sotomayor has a track record for ruling on the side of the environment, giving some hope to environmental groups. Specifically, in the past she ruled against the Bush administration-era EPA allowing companies to use cost-benefit analysis when deciding whether or not to upgrade plants to protect fish in waterways. She and others on the Supreme Court correctly saw this as an “out” for upgrading plants.
Sotomayor’s opinion on the case read: ““The statutory language requires that the … selection … be driven by technology, not cost,”.
